Please ensure you read the information regarding selling and buying your items carefully and be aware that wedding dresses, evening wear and wedding accessories are high value items which could be targeted by scammers. The term ‘Dress Come True’, ‘our’, ‘us’, or ‘we’ refers to the owner of this website, Layali Tech FZCO, a free zone company registered in Dubai Silicon Oasis with the company license No. 2755, having its registered office at DSO-THUB-G-D-FLEX-G013E, Dubai Silicon Oasis, United Arab Emirates (“Layali Tech”). The term ‘you’ refers to the user or viewer of the website.

Dress Come True is a web based listing service provided by Layali Tech that connects buyers and sellers of new and preloved wedding dresses and evening wear, focused on the Middle East region. Dress Come True is not an authorised dealer or agent of any of the items listed on its website. Designer dresses and items offered on this website are registered trademarks of their original owners who have no affiliation or endorsement to the website. Dress Come True does not own or store any dresses or products and does not deliver such products.

 

  1. License and Website Access

Dress Come True is an online listing platform allowing individuals or businesses to sell new or preloved wedding dresses, wedding accessories and evening wear and allows buyers to interact directly with sellers through private communication.

Dress Come True is not directly involved in the transaction between sellers and buyer (except in relation to our Concierge Services). As a result, Dress Come True has no control over the quality or legality of the items listed, the accuracy of the listings, the ability of sellers to sell items, or the ability of buyers to pay for items. Furthermore, Dress Come True cannot guarantee the true identity, age, and nationality of a user.

 

By using our Website, you agree NOT to:

 

  • Use the website or materials for any illegal purpose.
  • Transmit any content or information that is illegal, fraudulent, threatening, abusive, obscene, or infringes our or any third party’s intellectual property or other rights.
  • Transmit any advertisements, solicitations, chain letters or other unsolicited commercial communication.
  • Engage in spamming.
  • Transmit any software or other materials that contain any viruses, worms, trojan horses, or other items of a destructive nature.
  • Copy, adapt, sub-license, translate, sell, or reverse engineer any portion of the website or software.
  • Remove any copyright, trademark or other proprietary rights or notices contained in the Website.
  • Mirror any part of the website without our prior written authorization.

Dress Come True requires sellers to provide accurate information on the website. However, we do not warrant that product descriptions or other content of the website is accurate, complete, reliable, current, or error-free. If a product listed by www.DressComeTrue.com is not as described, you will have to deal with the seller directly to resolve your dispute. Dress Come True is not involved in or in any way liable for any portion of the sale (except in relation to our Concierge Services).

In particular, neither Layali Tech FZCO nor any of its directors or associated businesses are liable for any indirect, incidental, consequential, punitive or other damages (including, but not limited to, damages for loss of business, loss of data or lost profits) arising out of the website or materials contained on the website.

The sole, exclusive, maximum liability to us for all damages, losses and causes of action shall be the total amount paid by you if any to access the website.

 

  1. Indemnity

You agree to indemnify, defend and hold us and our directors, officers, employees, consultants, harmless from and against any and all claims, damages, losses, costs (including reasonable attorneys’ fees) and other expenses that arise directly or indirectly out of:

  • your breach of this agreement; and
  • your use of material that infringes copyright and intellectual property rights.

 

  1. Limitations to the Delivery of the Service

We do not guarantee continuous, uninterrupted or secure access to our services. Further, operations of the website may be interfered with by numerous factors outside of our control and we shall not be held liable for any such interruptions.
We reserve the right to make changes to, suspend, terminate or interrupt our services, fully or in part, at any time, without notice and with no obligation to provide reasons for such actions. We shall not be held liable for any damages resulting from failure to deliver the services set out in these Terms and Conditions as a result of the non-operation or incorrect operation of electronic means of communication for reasons beyond its control.

This includes, without limitations, malfunctioning of servers and other electronic devices, including where these are not an integral part of the internet network, malfunctioning of installed software, computer viruses or actions by hackers or other users with access to the network.

 

  1. Trademarks

This website contains material that is owned by, or licensed, to us. This material includes, but is not limited to the logo, design, layout, look, appearance and graphics. Reproduction is prohibited other than in accordance with the copyright notice, which forms part of these Terms and Conditions.

 

  1. VAT

At any future date Dress Come True may charge VAT for its services where legally required and where applicable in accordance with the laws and regulations of the United Arab Emirates.

 

  1. Laws and Jurisdiction

These Terms and Conditions and any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with it or its subject matter or formation shall be governed by and construed in accordance with English law.

The courts of the Dubai International Financial Centre, Dubai, United Arab Emirates shall have exclusive jurisdiction to settle any dispute or claim (including non-contractual disputes or claims) arising out of or in connection with these Terms and Conditions or its subject matter or formation.

 

 

CONCIERGE SERVICE

 

These Terms and Conditions govern the use of our Concierge Service and apply in addition to our general Terms and Conditions.

You, the seller, hereby entrust Dress Come True to:

  • List your wedding dress on your behalf on www.dresscometrue.com by creating and displaying on the website a description of the dress.
  • Handle all buyer communication including price negotiations, subject to any minimum accepted price determined by you and guided by us.
  • Provide all necessary information requested by buyer.
  • Support with insurance of the wedding dress and shipment to the buyer, in the event of a sale incl. shipment.
  • Receive in your name and on your behalf via secure payment gateway the amounts transferred by the buyer of the dress, corresponding to the sale price of the dress determined by you.

 

You, the seller, confirm and agree to the following:

  • The dress has a resale value of minimum AED 6,000 | $ 1,634 and not older than year 2017.
  • You are the sole owner of the dress and you have the full legal capacity to sell it.
  • You acknowledge that you are solely responsible for the authenticity and the origin of the dress.
  • You agree to share all the correct information related to the dress with us.
  • You acknowledge that you have read, understood and undertaken to respect the general Terms and Conditions of the website in addition to these specific Terms and Conditions for the Concierge Service.
  • You agree to pay the listing fee on the ‘sell page’ specific to the Concierge Service.
  • You will not hold us liable for any damage that could happen to the dress, e.g. during trial by a potential buyer.

 

In addition:

  • You authorise us to debit from the selling price of the dress (i.e. the price at which you are selling the dress) 30% commission or a minimum of AED 1,000 (whichever amount is higher) which is due to us in consideration of all of the services provided. The commission is additional to the initially paid listing fee.
  • You understand that professional photography of your dress is not included in the service.
  • By submitting your photos to us you allow us to use these photos to promote your dress on Social Media and to share them with potential buyers.
  • You understand that dry-cleaning of your dress is not included in the service and could be arranged at an additional cost.
  • You understand that we will not (physically) store your dress and the dress will remain with you until sold and shipped.
  • You are aware that we are not and will not in any circumstances be the owner of the dress.
  • At any future date Dress Come True may charge VAT where legally required and where applicable in accordance with the laws of the United Arab Emirates.
  • You understand that although we do our utmost to promote and sell your dress, a sale cannot be guaranteed.

 

 

COPYRIGHT POLICY

 

  1. Our Policy

Dress Come True seeks to abide by all applicable copyright laws, and respect third-party intellectual property rights and expects its users to do the same.

Our Photo Guide clearly asks users to use their own pictures and avoid using images that are subject to copyrights (e.g. catalogue pictures or pictures taken from the internet or any other source).

If any user uploads images (photographs, sketches, designs etc.) that are protected by copyrights, Dress Come True will take the following actions:

  • remove the allegedly infringing material from the website; and
  • if needed, terminate the user account that infringed the copyright of others.

 

  1. Working with Copyright Holder

If you are a copyright holder and you are reasonably certain that any image(s) posted on our website infringe your copyright, please contact us at hello@dresscometrue.com to raise the matter to our attention. Please identify yourself (name and email address) and the material or images that you believe has infringed your copyrights.

 

 

SELLER AGREEMENT

 

Use of Website

By listing items for sale on this website you agree to:

  • Treat all buyers with respect and use appropriate language for any communication done via our website, in compliance with local laws, ethics and etiquette.
  • Not to send any spam or commercial advertising of any kind.
  • Be solely responsible for the accuracy of the information provided, representing the true condition of the items to be sold by you (including any flaws) and agree to be liable for any third-party claims arising from your listing and the images posted by you, including any copyright or other intellectual property infringement claims.
  • Include only one single item for sale in each listing. Listings may not contain offers to purchase other items offsite, refer to other items for sale, or direct users to another website.
  • Give Dress Come True the license to use the content you upload, without charge, liability or additional compensation.
  • Consent to your listing remaining active on the website until the item is sold or removed by you.
  • Be solely responsible for managing your sale. We have no involvement or liability within the item transaction (except in relation to our Concierge Services).
  • Notify us when your dress or item is sold at hello@dresscometrue.com within seven days.
  • Consent to us reserving the right to request information or images to verify the legitimacy of a listing posted by you on our website.
  • Consent to us reserving the right to cancel your listing and/or user account should it be determined to be fraudulent, inaccurate, misrepresented, in violation of our listing terms or for any other viable reason. No refunds will be given in these situations.
  • Consent to not listing your dress/item on any other online marketplace/portal.
  • By submitting your photos to us you allow us to use these photos to promote your dress on Social Media and to share them with potential buyers.

 

Payment Options

You agree to offer buyers a secure payment method via our secure third-party payment gateway, in addition to other payment options. We will receive the funds from the buyer and then securely transfer them to your bank account. This is an additional service to secure your payment for which we will charge 5% of the selling price (i.e. the price at which you are selling the dress) or a minimum of AED 250 (whatever amount is higher).

 

This is how payment through our 3rd party payment gateway works, step by step:

  • You and the buyer agree on the selling price including shipment, import duties, tax as well as insurance, fuel surcharge and government levies (if applies). Please note that the purchase price for all items must be agreed between you and the buyer without any involvement from Dress Come True.
  • Write to hello@dresscometrue.com and share the buyer’s details, your bank details, the dress/item details and the payment amount, based on which we will send the buyer an invoice.
  • Buyer will pay the amount through the payment gateway, using her credit or debit card.
  • When we receive the amount we will notify you and ask you to ship the dress/item and share the airway bill of the shipment with the buyer to enable tracking.
  • When the dress/item is received by the buyer she will notify us and we will send the money to your bank account. Please note that you authorise us to debit from the selling price of the dress/item a 5% commission as a handling fee or a minimum of AED 75 (whichever amount is higher).
  • If the dress/item arrives not as described (any damage not previously disclosed), the buyer must immediately raise a dispute with you. In case you are not able to resolve the issue directly with the buyer, she can open a dispute at the dispute center of the 3rd party payment provider (subject to payment using payment provider). The buyer has no right to raise a dispute if she changes her mind about the dress/item or doesn’t like it.
  • You will accept the resolution of the dispute center as final.

 

Returns and Disputes

  • Unless otherwise agreed with the buyer, there are no returns for pre-loved (used), sample or new items.
  • No refunds being given (for listing fee) once a listing has been posted or listing credit purchased.
  • In case of a dispute resulting from a sale/transaction conducted face-to-face or via any other payment or transfer method outside our secure third-party payment gateway you will resolve issues with the buyer directly, without our involvement.

 

VAT

Acknowledge that at any future date Dress Come True may charge VAT where legally required and where applicable in accordance with the laws of the United Arab Emirates.

 

SHOPPING AGREEMENT

Use of Website

By interacting with sellers and buying items through this website you agree to:

  • Treat all sellers with respect and use appropriate language for any communication done via our website, in compliance with local laws, ethics and etiquette.
  • Not send any spam or commercial advertising of any kind.
  • Pay for all items ordered through our website in one payment.
  • Request an airway bill once items are shipped to track your order.
  • Pay for any shipping costs and insurance.
  • Pay any customs duties and related taxes.

 

Please note that any refusal to make payments in accordance with this Shopping Agreement may result in losing the dress/item and the payment.

 

Payment Options

You have the right to request payment via our secure 3rd party payment gateway, in addition to other payment options. We will receive the funds then transfer the funds to the seller’s bank account once the dress is shipped to you.

 

How payment through 3rd party payment gateway works, step by step:

  • You and the seller agree on the selling price including shipment, import duties and tax as well as insurance, fuel surcharge and government levies (if applies).
  • Seller will share with us your details and the payment amount, based on which we will send you an invoice.
  • You will pay the invoice.
  • When we receive the amount we will notify the seller and ask her to ship the dress/item and share with you the airway bill of the shipment to enable tracking.
  • When dress/item arrives you have to notify us so we can pay the seller.
  • If the dress/item arrives not as described (any damage not previously disclosed), immediately raise a dispute with seller, if you are not able to resolve the issue directly with seller, open a dispute at the dispute center of payment gateway (subject to payment using payment gateway). You have no right to raise a dispute if you change your mind or don’t like the dress. In this case you can always resell it on Dress Come True.
  • You will accept the resolution of the dispute center as final.

 

Returns and Disputes

  • Unless otherwise agreed with the seller, there are no returns for pre-loved (used), sample or new items.
  • Any dispute arising from you transacting directly with the seller either face-to-face or via any other payment or transfer method outside our secure 3rd party payment gateway will have to be resolved by you, without our involvement.

 

VAT

Acknowledge that at any future date Dress Come True may charge Value Added Tax (VAT) where legally required and where applicable in accordance with the laws of the United Arab Emirates.
